The City of Rye Police Department arrested Jaime D. De La Rosa, 34, of Harrison on Tuesday, July 28, and charged him with Driving While Intoxicated and Criminal Obstruction of Breathing or Blood Circulation following a domestic incident two days earlier.

The charges stem from an incident that occurred on Sunday, July 26, according to a MyRye.com report on the arrest. He has no known prior arrests.

The department declined to release further details, citing the domestic nature of the case.

Under New York Penal Law § 121.11, Criminal Obstruction of Breathing or Blood Circulation is a class A misdemeanor punishable by up to one year in jail. The charge applies when a person intentionally impedes another's normal breathing or blood circulation by applying pressure to the throat or neck, or by blocking the nose or mouth.

DWI is also a misdemeanor in New York for a first offense.

De La Rosa is presumed innocent unless and until proven guilty in a court of law.
